I think you can apply for I-140 with a copy. As far as I know, you cannot use premium processing though.

You will need:
Form 134 affidavit of support (no notorization required)
employment letter
pay stubs
letter from the bank regarding present balance and avg balance in previous years
bank statements for the past six months
income tax documents
invitation letter - why they are coming here
identifications - relationships (your original birth certificate); photocopy of your passport and your legal status proof

but if i wait until my PD is current, then i contact congressmen, by the time they act on it, pd may go out of current. So just looking to get it out of this loop before my pd is current, so that my file will be ready to process.

I know there was a recent bulletin that changed the filing location of I-765 .

My brother is finishing his BDS in India this year. I am planning to bring him to US for the studies in USA. Could you please help me on what he needs to do to enter here and are there any hurdles. I am new to USA too so don't know much about the ways so trying to find out. All I heard is unlike engineering its difficult to come for medical studies to USA.

I paper filed my EAD at NSC last month. RD was 23rd Sept & ND was 2nd Oct.
Looks like yours is a longer delay. Not sure what can be done here. Please keep checking to see if check's are cleared.

As far as I recollect, the Murthy article was about the spouse(dependent) receiving a GC (as part of a derivative spousal application) when his/her spouse(primary beneficiary)'s PD or her PD was not yet current.
Primary beneficiary had not received the GC, but spouse received it in error. May be that's diff from the situation where the primary beneficiary himself/herself receives the GC while the PD is not current.

It is unlikely that your husband will have a problem. As another poster said, he just needs to show that he is maintaining H-1B status. A very difficult CIS officer could take the view that he is not maintaining status if he is not being paid the prevailing wage. However, that is very unlikely. Underpaying an employee is an employer violation, not an employee violation.

My attorney is encouraging me to take part in the proposed AILF Class Action Lawsuit against the Government by submitting I-485 to USCIS knowing that its going to be rejected. Anyone decided on this? What are the pros and cons? If there is a favorable outcome, I-485 may be accepted at that time (months? / years?). But here is my big concern: if I am a part of that lawsuit, my 485 may be considerably delayed (my PD is Feb 2005) ! I am aware that IV is encouraging lawsuit too. Any comments?
