I think you can apply for reinstatement from within U.S. Check with the International Students Office at your school.

On the VFS site it lists the following docs:
Spouse / Dependent Children
1. Passport, visa fee receipt issued by HDFC Bank and interview appointment letter.
2. The original Notice of Action Form I-797 of the Principal Applicant.
3. Form I-129 (if Form I-797 is a blanket permit, copy of Form I-797 and I-129) of the Principal Applicant, and letter from employer that describes the relationship with the Principal Applicant and the purpose of travel.
4. Photocopy of the Principal Applicant�s valid visa (if applying separately).
5. Original Marriage Certificate (for spouse) along with your entire wedding photo album.
6. Original Birth certificate (for each child).
The one that stands out is #4.
Since I am in the US and have NOT gone for Visa Stamping, how can we furnish this..??

Compositionally, the picture feels slightly off balance to me, but I love what QJ did with the shadow detail and color in her first revision of your photo. There's certainly plenty of potential waiting to be brought out from within that image.

Isnt the three year extension valid only if you cannot file your I-485 because of retrogression? Once you file your 485, you get only a year?

You can try but they recommend going to your own country for stamping if there is a change in status (H1 to F1 or vice versa). If you to Mexico, please have a plan B.

Hello Gurus,
Pl guide me and let me know my options for the below scenario...
1. Me: Applied under EB2 (India) and have I-140 approved in September 2006.
Status as of now : Applied as dependent (secondary) on my spouse 485 and have EAD and AP since July 2007.
2. My spouse : Primary applicant - EB3 (India), December 2003.
As the dates are NOT moving forward for EB3 (India), I want to port our GC application dates from my spouse priority ( EB3- India - December 2003) to mine (EB2 - India - September 2006)
My question is, Can I change my status from dependent (secondary ) on my spouse 485 to me being primary applicant by invoking my approved I-140 (EB2 - India - September 2006), If YES what would be the process.

I think you will have to wait until the first transfer petition is completed. Please check with an immigration attorney. You can file I-907 to expedite the processing using premium processing. Again, please check with an attorney before you proceed.

Can the lawyer ask for the missing form; and will it have to be done by the USCIS at the I-140 stage? I was under the impression that only the USCIS can do this?

Her employer is filing her H1 COS petition in premium processing, so I am hopeful it will be adjudicated within 15 days.
One more thing you can do is that file your wife's H4 to H1 in regular processing and any subsequent H1/H4 transfer you would do can be filed in premium and get them approved. I am sure if H4 to H1 COS is filed in regular processing, it will surely take a minimum of 4 to 5 months to be processed.

I am currently working for Company A which sponsors my H1B. I wonder if I can work for another company on a part time basis. What's the requirement for concurrent H1B filing? And does concurrent H1B filing requires a new H1B application against the quota? Please provide guidance.

I got a notice today saying that my H1B withdrawal notice has been sent on Sep9th (today).
My new employer applied LCA yesterday (09.08.2009) for my H1B transfer.
What is my status now? can I transfer H1B to new company?
Is my old H1B revoked?
what is my next step to do to stay as legal immigrant?

Here is my h1b status:
1. We have applied for H1B visa extension in premium on March 23rd, 2010.(for 15 months, as I have this period remained on H1 6 years and I-140 not approved yet).
2. I have joined new client on March5th new project, new location.
3. USCIS raised RFE on March 9th, 2010 but not received the RFE document.
4. My employer sent H1B Amendment documents on March 15th, 2010 with new LCA.
5. Received RFE document on March 30th, 2010 from USCIS and replied on March 31st to USCIS.
6. USCIS approved case on April 10th, 2010 with 1 year duration, which is May 2011.
7. USCIS approved amendment on Dec 5th, 2010 which is valid until Aug 20th, 2011 which the max of 6 years period.
Now question, it means my H1B visa valid until Aug 2011?
