    Apply H4 with lawyer or by ourselves? My lawyer took care of my H1B, green card cases. Do I need to apply H4 for my wife through my lawyer? What is the advantage of using lawyer with H4 application. Can I apply it by myself? Is there any H4 application checklist around? Thank you.

    Hello All,

    My first I-140 (EB3) got denied and is pending in appeals office for more than 1-1/2 years. Since 140 was denied my 485 was also denied.

    Later we filed new labor (in 2009) and 140 (EB-2) and got approval after 8 months.

    My questions are:

    1. Can I file 'motion to reopen' for 485s based on new 140 approval and use the previous priority date (which is 2004)?

    2. If not, can I file motion to reopen 485 based on old 140 (which is pending in appeals office) and later if they are open, can we link these 485s with new 140?

    Please advise.

    How can you MTR for the 485 which was denied based on a denied 140? What were the grounds for denial? You might have to wait for the approval of the old 140 and then use that PD? You can port the old PD provided the older application is finally approved following the apeals. Just my 2 cents. Check with others/attorney.

    You will need:
    Form 134 affidavit of support (no notorization required)
    employment letter
    pay stubs
    letter from the bank regarding present balance and avg balance in previous years
    bank statements for the past six months
    income tax documents
    invitation letter - why they are coming here
    identifications - relationships (your original birth certificate); photocopy of your passport and your legal status proof

    Start renewing your passport asap. Its not a good idea to send expired/to be soon expired passport to USCIS. We will never know what kind of questions they ask. So my advise is please renew the passport asap. It takes max 2 weeks (Indian passport not sure about other countries).

    just wanted to give an update on my H1-B transfer,
    it is approved and I'm still waiting for my renewed passport from SFO.

    no issues. My mom travelled to mumbai from chicago via frankfurt on AI. everything went well.. no issues on wheel chair as they took care of her well in transit and dropped her at the gate.
    She did report issues in mumbai when she landed as it took 30 mins for wheel chair person to arrive at the gate... same AI has pathetic service in india and they are OK in US.

    After digging thro' forums it seems everyone talks about having the "intention" of staying with the Employer after GC.
    Here's my question.
    - Should the "intention" be on the day of filing 485 or the day you get GC ? (a date in future that no one can predict).

    If the "intention" has to be at the time of 485 filing then, after 180 days of filing 485 one should be able to change employers, irrespective of the case being approved or NOT.

    Yes, Travel via London needs:

    EITHER Valid Visa stamping in Passport to Destination Country

    OR Direct-Air-Transit UK Visa stamping in Passport

    Advance Parole is really a valid Entry Permit - but, it has a class about the officer may still deny your admission. This class is a statement to send the candidate back if they do not want to allow due to some issues after the AP is issued, etc. So, some countries (like UK) do not allow to fly in AP without valid visa stamping.

    FYI: My friend travelled via Germany and he returned back OK. Going to India via Germany is not an issue for Indian Citizens - but, Germany had the same rule as UK 2 Yrs back for returning to USA sector. Looks like, Germany allows transit travel using APs now-a-days. Not sure 100% about return to USA using AP , better to check.

    2.Do I need to be with the employer who filed PERM in order to get the H1b
    extended beyond 6 years using I-140 or can a new employer file for my
    extension using the approved I-140( without having a pending 485
    application ) ?

    You can use your 140 approval notice copy to extend beyond 6 years. It does not matter to which employer the 140 belongs to. It is not mandatory that you should have 485 pending.

    The easiest solution would be going to MataMoros, Mexico for stamping. This is the best option for us. Easy, affordable, and takes only 1 day. India, you need to answer several questions, interview to be attended, and ofcourse, they treat everybody as though the person requesting for visa is a criminal.

    I went to mexico couple of days back, and it was done easily

    Hi,

    My NIW/I-140 application has been pending for a year. During this time, I have more qualifications added to my resume. Is there a mechanism to send my updated resume or should I just let it be?

    Thanks.

    They asked me to send additional evidence in support of my NIW petition. I'd say just wait for them to ask you anything that they require to justify NIW.

    I applied for 485/EAD/AP in the month of June'2007.
    I got the receipt and my finger printing is done.
    Now my EAD/AP?485 are in pending approval stage.

    At this time, I need to travel out of country for urgent reasons,

    how it will work.

    I have H1B stamped on my passport which is valid till March'2010.

    Is it OK to travel on this H1B and re-enter or as my finger printing is done, I am already on AOS status.
    Please help.

    I worked for company A as a full time employee from May 21st,07 to July 11th,08 and then company B filled my H1B transfer on June06th,08 and I joined company B on June 17th, 08 as a full time employee.

    So there is a overlap, I mean I worked for company A and Company B as a Full time employee from June 17th,08 - July 11th,08 and got full time salary from both of these companies.

    1. So will it be a issue, if companyB or some other company sponsers me a Green card in future?

    2. Can I use the experience letter issued by the CompanyA for Green Card purposes? If not then shall I mention to my attorney/Company who will sponser me Green card that I worked for companyA till June 16th,08 and there is no overlap.

    I have H1 from a consulting company.Now the client I work for has asked me if I'd like to join their company.The problem is they won't sponsor H1's.I'm willing to talk to an attorney and pay expenses for transfer.Can someone tell me if it's possible.If yes then what are the supporting documents we need from the client to transfer?

    Lost I20.
    Went to school from 96 to 2000.
    WOrking on H-1 since then.
    Numerous trips outside. Last one in 2005 on an H-1 visa.
    What do I do now?

    You can call the school's "Office of International Studies"(or equivalent) and ask for a copy.
